1. Introduction
These Terms & Conditions apply to all photography services provided by honey & havens, operated by Jessica Franov (“the Photographer”) in Vienna, Austria. By booking a photography session, the client (“the Client”) confirms that they have read, understood, and agreed to these Terms.
2. Services
honey & havens provides professional photography services including portrait, couple, engagement, family, lifestyle, event, and branding photography. Each session includes planning, photography, professional post-production editing, and digital delivery of the final images.
3. Artistic Style and Creative Direction
Photography is a creative service, and the Client acknowledges that they have chosen honey & havens based on the Photographer’s existing portfolio and artistic style. The Photographer retains full creative discretion in relation to composition, lighting, colour grading, editing, and final image selection. As a result, no specific poses, images, or aesthetic outcomes can be guaranteed, and subjective dissatisfaction with artistic interpretation does not constitute grounds for complaint or refund.
4. Booking and Contract Formation
A booking is considered confirmed only once written confirmation has been issued by honey & havens and a non-refundable booking deposit of thirty percent of the total fee has been received. The deposit secures the agreed date and is deducted from the final invoice. No reservation is made until both conditions have been fulfilled.
5. Fees and Payment
A booking deposit of thirty percent is required to secure the session. The remaining balance is due no later than five business days after the photography session. Image delivery will not take place until full payment has been received. In the event of late payment, delivery may be delayed until outstanding amounts have been settled.
6. Client Responsibilities
The Client is responsible for arriving on time and adequately prepared for the session, including appropriate clothing, styling, and coordination of participants where applicable. The Client also ensures that any necessary permissions for locations or venues have been obtained in advance. Where delays occur due to the Client, the session time may be reduced accordingly without entitlement to refund or reshoot.
7. Cancellation
If the Client cancels the booking, the booking deposit remains non-refundable in all cases. Where cancellation occurs more than fourteen days before the scheduled session, only the deposit is retained. Cancellations made between seven and thirteen days before the session require payment of fifty percent of the total fee. Cancellations made less than seven days before the session require seventy-five percent of the total fee, while cancellations within twenty-four hours or failure to attend the session will require payment of the full amount.
8. Rescheduling
The Client may reschedule the session once free of charge, provided that at least fourteen days’ notice is given and the new date is subject to availability. Requests to reschedule with shorter notice may incur an administrative fee of up to ten percent of the booking value. Further rescheduling requests are subject to agreement by the Photographer.
9. Weather and External Conditions
For outdoor or location-based sessions, the Photographer is not responsible for conditions outside their control, including weather, lighting, venue restrictions, or access limitations. Where necessary, the Photographer may offer a reschedule or adjustment of the session. If a reshoot becomes necessary due to circumstances related to the Client, additional fees may apply.
10. Travel and Location
Travel within fifteen kilometres of Vienna is included in the session fee. For locations beyond this area, a fixed travel fee will be agreed with the Client in advance of the session. Any additional costs such as parking, tolls, or location-specific fees may be charged where applicable and will always be communicated in advance.
11. Session Duration and Overtime
Each session is scheduled for an agreed duration. Should the session extend beyond the agreed timeframe due to client requests or circumstances, additional time may be charged at a rate of one hundred and fifty euros per hour or part thereof, unless otherwise agreed in writing.
12. Image Delivery
Final edited images are delivered digitally within up to four weeks after the session via Pic-Time or a comparable online gallery service. The Client is responsible for downloading and securely backing up their images within one month of delivery.
13. Editing and Image Selection
The Photographer retains full creative control over the selection and editing of images. Not all photographs taken during a session will be delivered. Only fully edited images are provided, and RAW or unedited files are not released under any circumstances. Minor revision requests may be accommodated once, while additional or significant changes may incur extra fees.
14. Use of Images
The Client is granted a personal, non-commercial licence to use the delivered images. This includes private printing, personal websites, and sharing on social media. Images may not be used for commercial purposes, sold, transferred to third parties, or altered through filters, editing tools, or artificial intelligence without prior written consent from the Photographer.
15. Copyright
All images remain the exclusive intellectual property of honey & havens and Jessica Franov under Austrian copyright law. No rights are transferred beyond the usage licence explicitly granted in these Terms.
16. Portfolio and Promotional Use
The Photographer may only use selected images for portfolio, website, social media, marketing, or competitions where the Client has provided separate explicit consent at the time of booking or enquiry. Such consent is optional and not a condition of the service.
17. Image Storage
While images are made available for download for a limited period after delivery, the Photographer does not guarantee long-term storage of files. The Client is solely responsible for downloading and securely backing up their images.
18. Cancellation by Photographer
In the unlikely event that the Photographer is unable to attend due to illness or circumstances beyond reasonable control, honey & havens will first attempt to reschedule the session or arrange a suitable replacement photographer where possible. If neither option is feasible, all payments received will be refunded in full. This refund constitutes the Photographer’s maximum liability.
19. Liability
The Photographer shall not be held liable for subjective dissatisfaction with artistic results, weather or environmental conditions, venue restrictions, or loss of images after delivery. Liability is in all cases limited to the total amount paid for the booking.
20. Consumer Right of Withdrawal
Where applicable under EU consumer protection law, Clients may have a fourteen-day right of withdrawal for distance contracts. However, if the Client requests that services begin immediately, including booking confirmation, planning, or preparation, they acknowledge that performance may begin before the expiry of this period. Where legally permitted, the right of withdrawal may be reduced or no longer apply once the service has been fully performed.
21. Governing Law
These Terms and Conditions are governed by the laws of Austria. Any disputes arising shall fall under the jurisdiction of Austrian courts.
